These are the terms for using this website. The terms for an actual project live in the written proposal you sign, and those take precedence over anything here.
Using this website
This site is for information. I keep it accurate and current as best I can, but I do not warrant that it is error-free or always available.
Nothing here is an offer you can accept. The prices shown describe the standard fixed scope. A project exists only once a written proposal has been accepted in writing by both of us.
The Website Gap Review
It is free, and it obliges neither of us to anything. It is a short set of observations, not a full audit, and not professional advice you should act on without your own judgement. Asking for one does not create a contract.
Intellectual property
The content, design and code of this website belong to me unless stated otherwise. You are welcome to read it, quote it and link to it. You may not copy it wholesale for commercial use.
For client projects: once the final invoice is paid you own the domain, the approved copy, your supplied images and the finished website. This is set out in full on the what’s included page and in the engagement documents.
No guarantee of results
I do not guarantee search rankings, traffic, enquiries or revenue, and nothing on this website should be read as promising them. What happens after launch depends on demand, your reputation, your competitors, and how you follow enquiries up.
Liability
[VERIFY] This section is drafted for business clients under the Unfair Contract Terms Act 1977. It has not been checked by a solicitor. If any client might be a consumer rather than a business, it needs redrafting, because the Consumer Rights Act 2015 applies different rules.
Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited. Those limits stand whatever else is written here.
Subject to that, and to the extent the law allows:
I am not liable for loss of profit, loss of business, loss of anticipated savings, loss of goodwill, or any indirect or consequential loss, however it arises.
My total liability in connection with a project is limited to the fees you have actually paid me for that project.
My total liability in connection with this website, where no project exists, is limited to £100.
Governing law
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
